TERMS AND CONDITIONS OF PARTICIPATION

 

Participation in the prize draw being conducted by Kalkhoff Bikes, hereinafter referred to as the ""Operator"" or ""Organiser"", is free of charge and is governed exclusively by these terms and conditions of participation.

 

Conduct of World Bicycle Day and the prize draw:

The duration of World Bicycle Day and the duration of the prize draw is from 3 June 2022 until 11:59 p.m. on 5 June 2022. Within this period, users will be given the opportunity to participate in the registration of kilometres and the prize draw by means of the contact form.

 

Participation:

To participate in the kilometre registration and the prize draw, you must enter all the mandatory data. Participation is only possible within the participation period. Submissions received after the end of the participation period will not be included in the draw. Only one submitted entry per participant will be entered into the prize draw. Creating multiple profiles to increase the chances of winning is strictly prohibited. Participation in the prize draw is free.

 

Eligibility for participation:

Natural persons who have reached the age of 18 are eligible to participate. Participation is not limited to customers of the Organiser and is not dependent on the purchase of a good or service. If a participant has limited legal capacity, the consent of his or her legal representative is required.

Persons involved in the conception and implementation of the prize draw and employees of the Operator, as well as their family members, are not eligible to participate in the prize draw. In addition, the Operator reserves the right, at its own discretion, to exclude persons from participation for justified reasons, including but not limited to (a) in the event of manipulation in connection with access to or the conduct of the prize draw, (b) in the event of violations of these conditions of participation, (c) in the event of unfair actions or (d) if the person has provided false or misleading information in connection with participation in the prize draw.

Notification of winning and handover of prize:

The following prizes will be given away:

3x Kalkhoff surprise packages, to participants

1x donation, to NABU – Naturschutzbund Deutschland e.V.

The winners will be determined after the end of the participation period by random draw from among all participants. If the competition is linked to a task, only those participants who have completed the task correctly will be entered into the draw. The winners of the prize draw will be informed of the prize in a timely manner by separate email.

The prize will only be handed over to the winner or the winner’s legal representative. Prizes may not be exchanged or collected personally by the winners. Winners cannot be paid the value of the prize in cash.

Any costs incurred for shipping the prizes will be borne by the Operator. All additional costs associated with claiming the prize will be borne by the individual winner. The winner is responsible for taxes incurred on the prize. If the winner does not respond after two requests within a period of 2 weeks, the prize is forfeited.

The donation to NABU will be the result of the total of the kilometres ridden by all participants. This is estimated at an amount of €0.50 per kilometre ridden, up to a maximum amount of €10,000.

 

End of the prize draw:

The Organizer expressly reserves the right to terminate the prize draw without prior notice and without stating reasons. This applies specifically, but not exclusively, to any grounds that disrupt or prevent the prize draw from being conducted as planned.

 

DATA PRIVACY STATEMENT

 

Personal data will be collected and used exclusively for the purpose of conducting the prize draw. The personal data will not be forwarded to third parties. Applicable law:

Questions or complaints in connection with the prize draw should be addressed to the Operator. The Operator’s prize draw is governed exclusively by the law of the Federal Republic of Germany. The selection of winners cannot be disputed at law.

 

Severability clause:

If a provision of these conditions of participation is or becomes invalid, whether in part or in full, this does not compromise the validity of the remainder of the conditions of participation. In that event, the invalid provision is replaced by the legally permissible provision that comes closest in economic terms to the meaning and purpose expressed in the invalid provision. The same applies in the event of a loophole in these conditions of participation.
